Los Osos teen arrested in connection with deadly hit-and-run in SLO

An arrest has been made in connection with a hit-and-run that killed a 22-year-old bicyclist in San Luis Obispo Tuesday night.

San Luis Obispo police say the suspect is a 17-year-old girl from Los Osos who reportedly admitted to officers that she had been drinking prior to the crash. 

The victim has been identified as Kennedy Love, 22, of San Luis Obispo, a landscape architecture student at Cal Poly, who police say lived nearby. 

San Luis Obispo police say officers responded to the area of Foothill Boulevard and Ferrini Road at about 11:30 p.m. and found Love unresponsive in the road. CPR was performed, but he died from his injuries.

Police say he was not wearing a helmet and it is unclear if lights on the front and back of his bike were on when he was hit. 

Police say witnesses reported seeing a vehicle with damage to the front driver’s-side window enter the Foothill Plaza parking lot. They say two females got out, appearing to be checking out the damage, before driving off.

The vehicle was found at about 1:00 a.m. abandoned on Tassajara Drive near Luneta Drive, according to police.

Officers say they then contacted the registered owner of the vehicle in Los Osos and it was at that time the teen confessed to hitting the bicyclist and admitted she had been drinking prior to the collision. 

She was arrested and faces charges of vehicular manslaughter, felony DUI and felony hit-and-run. Her name has not been released due to her age.

Police say they are speaking with the person who may have been with her at the time of the collision. It is not known if that person will face any charges. 

Foothill Boulevard was closed for several hours between Ferrini Road and Cuesta Drive while the investigation took place.

Deadly Crash on Highway 101 at Cuesta Grade

A Fresno teen is under arrest for DUI in connection with a deadly crash on Highway 101 that closed down the Cuesta Grade Tuesday night and killed two of his passengers, according to the California Highway Patrol.

Emergency crews responded to the scene in the southbound lanes, south of TV Tower Road, shortly before 11:00 p.m.

Officers say the driver, identified as Robert Dave Jones II, 19, of Fresno, was driving “at a high rate of speed” when he turned the car to the right, causing it to go up a steep embankment before heading back onto the road where it crashed into the center divider.

The two back seat passengers, identified as Cody James Wiebers, 21, and Jubalee Stoney Jones, 20, both from Fresno, were ejected and died at the scene, according to CHP. Officers say neither were wearing a seatbelt. 

The passenger in the front seat, identified as Cynthia Rendon, 20, also of Fresno, was taken to the hospital with minor injuries but has since been released.

CHP says the crash was caused by Jones’ intoxication. He was hospitalized with major injuries and, according to local hospital officials, has been transferred to Fresno Community Hospital. 

At least one additional vehicle became involved after hitting one of the ejected victims on the highway.

All lanes of Highway 101 in the area were back open by 5:00 a.m.

Motorcyclist taken to hospital after collision in Paso Robles

A motorcyclist was taken to the hospital to be treated for injuries suffered in a collision with another vehicle Monday afternoon in Paso Robles.

It happened at about 2:30 p.m. at Spring and 7th streets.

According to police, witnesses said the driver of a sedan was turning left from 7th Street onto Spring Street and struck the motorcycle. Police say the driver’s view was partially obstructed because of a truck parked along the road.

The male motorcycle rider was reportedly ejected from his bike onto the street. The extent of his injuries is unknown. The driver of the sedan was not hurt.

The intersection was closed to traffic while officers conducted their investigation.

Authorities Identify Woman Killed By Train In Montecito

Authorities have released the name of the woman who was struck and killed by an Amtrak passenger train on Saturday afternoon in Montecito.

Elaine Enick, 62, of Montecito was fatally injured when she was hit by the northbound Pacific Surfliner at about 3:20 p.m. in the area of Butterfly Lane, said Kelly Hoover, a spokeswoman for the Santa Barbara County Sheriff’s Department.

The conductor of the northbound Pacific Surfliner told investigators that Enick was walking along the side of the tracks, and the train’s horn was sounded to warn her.

Moments later, she stepped onto the tracks and was struck and fatally injured, according to the Sheriff’s Department.

“The sheriff’s Coroner’s Office is conducting an investigation to determine the circumstances surrounding the incident,” Hoover said.

Car Accident Liability: Lane Changing

Getting to the hospital right away is essential if you are involved in a car accident liability case in order to have the records to back up your claims. After you are out of the hospital and feeling better, we will begin to examine just who was at-fault in the accident. A lane changing car accident liability case is not always that simple to prove, as most highways and multi-lane roads have higher speed limits and heavy traffic. With drivers weaving in and out of traffic all of the time, it can be difficult to determine just who caused the accident. There are a couple of important factors that will go into your liability case if you were hurt because of a lane changing accident.

Four Factors in an Accident 

The four factors we will look closely at are breach, duty, causation, and damages.
Breach: Did the other driver fail to meet his duty of checking all around before he or she changed lanes, causing an accident to occur?
Duty: All drivers have a duty to drive responsibly at all times, which the driver who allegedly caused the accident may have failed to do.
Causation: Were you injured due to another driver changing lanes, or were you injured as the result of another driving matter?
Damages: Did you or another passenger suffer injuries that you can prove through medical records? Are you suffering from emotional distress since the accident occurred?

Establishing Liability in a Lane Changing Case

If the other driver committed an illegal maneuver that resulted in a lane changing accident, this may help prove that they are at-fault. Most states have laws concerning changing lanes that all drivers must obey or face penalties or fines. For example, a driver must always signal correctly when they are about to make a lane change or while they are in the process of making a lane change.
